Consent to Data Collection and Processing

Effective: July 15, 2024

The contracting party has conducted an informational conversation with Ging IT GmbH or has concluded a purchase contract.

In the context of this agreement, Ging IT GmbH collects, stores, and processes the following personal data to fulfill the service:

  • Company name (if applicable)
  • Name and title
  • Position within the company
  • Contact person
  • Company address or address of the natural person
  • Contact details (telephone number, fax, email address, etc.)
  • Company registration number
  • VAT ID number
  • Bank details, credit card information
  • Website
  • Order data
  • Customer service inquiries
  • Product interests
  • Communication related to the purchase contract, emails, and records.

The contracting party hereby confirms that they consent to the processing of these data. The aforementioned service of Ging IT GmbH can only be provided if the data in question are made available for processing. The legality of data collection is ensured in accordance with Art. 6 GDPR, Paragraph 1, Point b. The information obligation towards the data subject is fulfilled by this statement. The principle of data minimization as per Art. 5 GDPR is respected.

The data have been voluntarily provided, and Ging IT GmbH processes this data based on this consent for the following purposes:

  • Execution of the order
  • Customer support
  • For own advertising purposes, such as sending offers, promotional brochures, and newsletters (in paper and electronic form), as well as for indicating the existing or previous business relationship with the customer (reference indication).

Rights: Access, Rectification, Deletion, and Blocking, Right to Object

The contracting party is entitled at any time, according to § 15 GDPR, to request extensive information from Ging IT GmbH (contracting party) about the stored data.

According to § 17 GDPR, it is possible at any time to request the rectification, deletion, and blocking of individual personal data from Ging IT GmbH (contracting party).

Furthermore, the contracting party can exercise the right to object at any time without giving reasons and modify or completely withdraw the consent declaration with effect for the future. Withdrawal can be communicated either by postal mail or by email to the contracting party. No costs other than postage or transmission costs according to existing base rates are incurred.

Ging IT GmbH is not required to appoint a Data Protection Officer. Ging IT GmbH has appointed a Data Protection Coordinator who will be happy to address your concerns. To withdraw consent, please contact: Ging IT GmbH, Tarviserstraße 18, 9020 Klagenfurt, Email: office@ging-it.com.

The data provided by the contracting party are also necessary for contract fulfillment or for carrying out pre-contractual measures. Without this data, this or other contracts cannot be concluded.

The data are stored for a maximum of 7 years (absolute statute of limitations 30 years) from the termination of the existing contractual relationship. This is the absolute statute of limitations according to the civil law provisions of the ABGB (Austrian General Civil Code).

For this data processing, we use processors. The data are forwarded to the following processors: transport companies such as postal or parcel service providers, IT administrators, tax advisors, lawyers, courts, etc.

Cookies

Our website uses so-called cookies, small text files that are stored on your device via your browser. They do not cause any harm. We use cookies to make our offering user-friendly. Some cookies remain on your device until you delete them. They allow us to recognize your browser on your next visit. Cookies are used to enable the analysis of the use of the website by users. The information generated is transmitted to the provider's server and stored there. You can prevent this by configuring your browser not to store cookies. We have entered into a corresponding data processing agreement with the provider. Your IP address is collected but immediately pseudonymized. Thus, only a rough localization is possible.

The relationship with the web analytics provider is based on the officially recognized determination of an EU-compliant level of data protection (e.g., for the USA through the “Privacy Shield”) or adherence to officially recognized special contractual obligations (so-called “standard contractual clauses”).

Data processing is carried out based on the legal provisions of § 96 Para. 3 TKG (Telecommunications Act) and Art. 6 Para. 1 lit. a (consent) and/or f (legitimate interest) GDPR. Our interest under GDPR (legitimate interest) is to improve our offering and our website. Since we value our users' privacy, the user data is pseudonymized. User data is stored for 90 days.

Legal Remedies

The contracting party generally has the rights to access, rectification, deletion, restriction, data portability, and objection. For this, please contact Ging IT GmbH. If the contracting party believes that the processing of their data violates data protection law or that their data protection rights have been otherwise infringed, they can file a complaint with the supervisory authority. In Austria, the responsible authority is the Austrian Data Protection Authority in Vienna.
